HIGHLY SKILLED MIGRANT PROGRAMME (HSMP)

Thinking about working abroad? Why not consider Britain's work-permit programme? The British Government, recognising the need to attract highly skilled workers, initiated this scheme in order to allow candidates living abroad to migrate to Britain without first having secured employment in Britain. In order to qualify, one must (a) score 6.0 on either IELTS examination (or have completed a bachelor’s programme taught in English) and (b) obtain seventy-five points on the basis of (i) age (ii) university degrees, (iii) earnings and (iv) British experience. The earnings bands are based upon age and country of employment. Alternatively, those who obtain an MBA from one of the fifty Treasury-approved schools will garner the requisite seventy-five points on that basis alone.

Applicants of any age may apply. According to Home Office statistics, 85% of applications were processed in 2006 within twenty-five (25) working days.

 

 

The two-stage processing leads to the recipient's being issued a two-year, open work permit. After two years, those who replicate in Britain their success abroad will be issued a three-year, open work permit, after which they may be granted “indefinite leave to remain”, which is to say, ‘permanent residence’, upon proof of their being financially self-supporting.

 

A spouse is issued an open work permit, children under 18 may attend public schools without paying foreign tuition and all family members have access to publicly-funded healthcare.

HSMP Fees and Procedures

Fees

The processing fee for an HSMP application is £315, and, after approval, £85 per migrant. For inland adjustment, the fee is £335.

Procedure

The procedure for being issued a work-permit under this scheme differs for those residing abroad and those lawfully residing in Britain, other than as a visitor. For those authorised to be processed from within Britain, it is a two-step, concurrent process. For those applying from abroad, it is a two-step, sequential process.

In-Britain Processing

Those who have been granted at least twelve months “leave to remain” in Britain, other than as a visitor, may apply from within Britain so long as they do not have a pending asylum-claim. Those who do not fall into these categories, or who are unwilling to withdraw an aslyum-claim, must apply from abroad and seek “entry clearance” before being permitted to work on an HSMP work-permit. These applicants submit a different application form, supporting documentation plus £335 and the passports and two photographs of the applicant and all accompanying dependants.

Overseas Processing

Those applying from abroad submit to the Sheffield office their HSMP application, supporting documents and fee. Within six months of HSMP approval, they apply for “entry clearance” at the diplomatic mission governing their place of residence or nationality and pay £85 per migrant. HSMP Work-Permits Approval Requirements

Applicants for HSMP work-permits must meet five selection-criteria; viz.,

  1. score at least 75 points from the selection criteria;
  2. score 6.0 or better on either IELTS examination, taken within two years; or have earned a bachelor's degree in a programme where the medium of instruction was English;
  3. establish an ability to be self-supporting in the U.K. in their chosen field;
  4. possess sufficient capital or income to be support themselves and their family in the U.K. without resort to public assistance; and
  5. be willing and able to make the U.K. their country of habitual residence.

 

HSMP Selection Factors

In assessing the merits of an HSMP applicant, the following factors are considered:

  • English,
  • age,
  • British experience,
  • completed, university education and
  • earned income for preceding tweleve months.

The programme sets differing levels of qualifying earned income depending upon the applicant’s age and country of residence. While youth is an asset, applicants of any age may apply.

English

Applicants are required to demonstrate a strong command of English via one of two methods; viz.,

  • by scoring 6.0 (out of 9.0) on the IELTS examination or
  • by having earned a bachelor’s degree where English was the medium of instruction. 

The IELTS examination may be either the ‘general’ or the ‘academic’ examination but must have been taken within two (2) years of application.  The Home Office will also accept equivalent examination results so long as NARIC views the result as being equivalent to an IELTS band score of 6.0 or better.

Graduate degrees taught in English will not be accepted as a substitute for an IELTS result because undergraduate programmes, generally being at least three years in length, require a greater display of English ability than do many master programs. 

Point System

In addition to having to prove English proficiency, one must garner at least seventy five (75) points from the following factors.

An award of points for British education is limited to a bachelor’s or graduate degree earned from a U.K. institution within the preceding five years and must included a least one year of studying lawfully in Britain.  Alternatively, earning at least £16,000 by lawfully working in Britain within the preceding twelve (12) months will generate five (5) points. The maximum score for this factor is five (5) points.

The degree must be from an accredited institution and be recognised by NARIC as being equal to an equivalent British degree.

 

Treasury-Approved M.B.A. Programmes

In order to entice the ‘best and the brightest’ to Britain, those who earn an M.B.A. from the fifty schools the Treasury Board has identified as being amongst the best in the world are awarded seventy-five (75) points for this degree alone, thereby assuring approval for those who can also pass the English requirement. Earnings

Other than for those holding an M.B.A. from a Treasury-endorsed school, in order to reach the pass-mark, sufficient points must be garnered from prior earnings, consisting of

  • salary,
  • bonuses,
  • allowances declared on pay-slips and
  • dividends from employer(s)

The accumulation period is the preceding twelve (12) months for full-time jobs and the preceding fifteen (15) months for part-time jobs.  For those who are currently students, the earning period extends back from the date of matriculation. 

Recognising that average incomes vary between countries, five income bands have been created.  Please click here to find the applicable band per country. For those who have worked in more than one country, the country of longest residence is the measure, and income is pro rated; i.e., divide the income earned by the number of months of residence and multiply by twelve (12).

Extending HSMP Status

At the end of the initial period of entry, an extension through the fifth year will be granted to those who:

  1. adduce proof of adequate English and
  2. score at last 75 points
The factors are the same as the initial criteria, except that “British experience” has been eliminated.

English

In addition to achieving at least 75 points, strong command of English must be established via one of two methods; viz., (a) by scoring 6.0 (out of 9.0) on the IELTS examination or (b) by having earned a bachelor’s degree where English was the medium of instruction. (Graduate degrees taught in English will not be accepted as a substitute for an IELTS result.)

The IELTS examination must have been taken within two (2) years of the initial HSMP application and may be either the ‘general’ or the ‘academic’ examination.  The Home Office will also accept equivalent examination results so long as NARIC accepts that the result is equivalent to an IELTS band score of 6.0 or better.

Failure to reach this standard will result in the application being refused.  However, those whose HSMP application had been approved prior to 8 November 2006 may take up ten (10) weeks after submission of the application for extension to submit IELTS results, during which time their application for an extension will be held in abeyance. Only IELTS results will be accepted in these circumstances.

Point System for Extension

In addition to competence in English, those seeking to extend their entry clearance through the fifth year must garner at least seventy-five (75) points from the following criteria:

For those issued a two-year entry, points for earnings will be awarded on the basis of twelve (12) consecutive months within fifteen (15) months of application. For those granted only one-year entry, the period is eight (8) consecutive months in the preceding twelve (12), and the amounts are roughly 75% of twelve-month levels. Earning may be from more than one job and includes, salaries, bonuses, allowances reflected on pay slips and dividends from one’s employer(s). Earnings from overseas may also be included. (Passive income, such as interest or rent, is not included.)

Transitional Provisions

For those whose HSMP application was approved prior to 8 November 2006, when the current scheme was declared, transitional provisions exist.  First, those who are not able to reach 75 points may convert to an employer-specific work-permit so long as (a) they have held the position for at least eight (8) months in the preceding twelve (if issued a one-year entry-clearance) or twelve (12) within fifteen (15) months (if issued a two-year entry clearance) and (b) the standard work-permit requirements are met except that the employer is not required to establish that no settled resident or E.U. citizen is able and willing to accept the position. 

Second, those who have established their own business in Britain may be granted an extension if the business has been active for at least four (4) months and has sufficient “ongoing contractual/business commitments to cover at least the next six months”.
